By using the Products and Services, you agree, without limitation or qualification, to be bound by, and to comply with, these Terms and Conditions and any other posted guidelines or rules applicable to any individual Park-by-Phone Product or Service. All such guidelines and rules are hereby incorporated by reference into the Terms and Conditions. You acknowledge and agree that Park-by-Phone.com may terminate your access to Park-by-Phone.com or to any of the Products and Services should you fail to comply with the Terms and Conditions or any other guidelines and rules published by Park-by-Phone. We may amend this Agreement at any time by posting the amended terms on the Site. All amended terms shall automatically be effective after they are initially posted on the Site.

Certain Products and Services will require the user to register and provide certain data. In consideration of use of such Products and Services, in registering and providing such data, you represent and warrant that: (a) the information about yourself is true, accurate, current, and complete (apart from optional items) as required by various Park-by-Phone.com registration forms ("Registration Information") and (b) you will maintain and promptly update the Registration Information to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or Park-by-Phone.com has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Park-by-Phone.com has the right to suspend or terminate your account and refuse any and all current or future use of the Products and Services. In cases where you have authorized a minor to use the Products and Services, you recognize that you are fully responsible for: (i) the online conduct of such minor; (ii) controlling the minor's access to and use of the Products and Services; and (iii) the consequences of any misuse by the minor.

Upon registering, you will receive a password and membership PIN(Personal Identification Number). You are responsible for maintaining the confidentiality of the password and PIN, and are fully responsible for all activities that occur under your password or PIN. You agree to (a) immediately notify Park-by-phone.com of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. Park-by-phone.com cannot and will not be liable for any loss or damage arising from your failure to comply with this requirement.

The cost of the program is $5.95 per year. You will be billed monthly for all phoned-in parking fees plus a 10% (or minimum 50 cents for charges accumulating less than $5.00) surcharge .    The annual membership is automatically renewed on the anniversary date of your inital registration.  If you do not wish to renew, you are responsible for contacting Park-by-phone PRIOR TO THE RENEWAL ANNIVERSARY DATE to advise of desire to cancel. If user account is turned over to a collection agency due to nonpayment, user will be responsible for collections fee of 35% of the outstanding balance and any associated reasonable attorney's fees.

THE PRODUCTS AND SERVICES ARE PROVIDED "AS IS," WITH NO WARRANTIES WHATSOEVER. ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS, ARE EXPRESSLY DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY LAW.

IN NO EVENT SHALL WE, OUR SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES OR OUR SUPPLIERS BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH OUR SITE, OUR SERVICES OR THIS AGREEMENT (HOWEVER ARISING, INCLUDING NEGLIGENCE).

You shall comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of our service.

Park-by-Phone will not use or share the Personally Identifiable Information collected on our site in ways unrelated to the purpose for which you provided the information. We store and process your information on computers located in the United States that are protected by physical as well as technological security devices.
